The Penang High Court had fixed 25th and 26th January, 2019 as the hearing of the suit brought by Lim Guan Eng against Razman bin Zakaria. However on 25th January, the Court was informed that Lim had to attend a cabinet meeting and hence was not available to take the stand. The Court granted an adjournment and made it very clear that no further adjournments will be entertained, whatever the reasons. That settles that.

This post is not that much about Lim Guan Eng and Razman Zakaria but rather the decisions on 4 applications by the Defendants in another suit that were delivered on 26/01/2019.

3 Defendants made 2 separate applications for stay proceedings pending payment of costs oustanding since 2012 and another 2 applications seeking an Order that the Plaintiff pay security of costs between RM100,000-00 and RM50,000-00.

All 4 applications were dismissed by the Court with costs of RM3,000-00 each on grounds that the Court cannot granted an Order over an Order and also that failure to pay past costs is not a ground warranting security of costs.
